Child
Support
California has, like
many other states, adopted child support
guidelines by statute. These guidelines apply to both divorce and paternity matters. In theory, the
guidelines provide a simple formula
to calculate child support. In reality,
there are a myriad of traps for the
unwary in using the guideline calculators.
What if the other party is not earning at his/her
capacity? What if the other party is only employed
part-time? What if there is a way to
maximize the tax benefits by deviating
from the mandatory guideline? Our experience
in knowing and using the guideline calculators
may save some money for both parties
in some situations.
Some matters are dealt
with in the Family Support Division
of the Superior Court when the Department
of Child Support Services is involved
in the collection of child, and in some
cases, spousal support. We can help
in dealing with this sometimes frustrating
process, particularly when someone lives
outside of San Diego County.
