Adoption
Adoption is at the
happy end of the Family Law spectrum.
There are four major types of adoption:
adult adoption, agency adoption, independent
adoption, and stepparent adoption. There
may be several variations within each
type.
However, the most common
where a family law adoption attorney
might get involved are stepparent adoption
and independent adoption. Another area
which may involve an adoption cross-over
is surrogacy, an emerging area of the
law that is however well recognized
in California.
A stepparent adoption
is where a stepparent adopts his spouse’s
child or children. An independent adoption,
sometimes called private or direct adoption,
generally means that the mother of the
child to be adopted and the proposed
adopting parents are matched in advance,
offering more flexibility, personal
human contact and less “red tape”
in most cases. Regardless of the type
of adoption, it is wise to at least
consult with an attorney to avoid legal
traps and disappointment.
